CozyBed Terms of Service

The following COZYbed terms and conditions apply to its internet website and all its online properties (the “Website”). The use of the Website, including the purchase of any product is subject to the following terms and conditions (the “Terms”). Throughout the Website, the terms “we”, “us” or “our” refer to COZYbed.

By visiting the Website, communicating with us and/or purchasing a product from us, you are indicating to us that you agree to these Terms as they are written here.

The Terms as displayed on here are our current policy. The Terms apply to all users of the Website.

COZYbed reserves its right to update, change or replace its Terms at anytime without any specific or direct notice to you. You agree that it is your responsibility to check and monitor our website for any changes. You may wish to review these Terms regularly to ensure that you are fully aware of any changes or updates. Your continued use of our Website will constitute acceptance of any changes.

If you do not agree to our Terms, then you must exit the Website immediately and you may not access the information or products obtainable or accessible through the Website.

Any ambiguities in the interpretation of the Terms will not be construed against COZYbed.

Payments

All payments are in Australian dollars (AUD).

Warranty policy

Any product purchased directly from COZYbed is covered by a warranty.

The warranty is not transferable and will only cover the original purchaser. The warranty will not cover products used for commercial purposes.

The warranty covers the replacement or repair of any product that has a manufacturing or material defect that is not the result of normal wear and tear, or a natural characteristic of the material used. The warranty does not cover minor imperfections, conditions caused as a result of using the mattress in a way it is not intended for, individual or personalised preferences such as those relating to comfort, texture or firmness.
We reserve our right to repair or replace the product or its material components.

If your item has been discontinued, we reserve our right to offer you a refund or similar replacement. Any repairs or replacement will not extend the original warranty.

Any conditions relating to health, allergies, discomfort, or other conditions are not covered by this warranty and should be addressed by your licensed physician.

The benefits provided in the warranty are in addition to other rights and remedies, to its maximum extent permitted by the applicable law. To the extent that they are compatible with the applicable laws, the exclusions and provisos that apply to the COZYbed warranty apply to the consumer guarantees.

Refunds

Any refunds issued to you will be in the same form of your original payment.

Your total payment to COZYbed will be refunded. If you purchased a product using a gift code or other discount, you will be refunded the total payment you made to COZYbed less any gift code or other discount.

If you purchased a product using finance options, you may incur extra charges implemented by that supplier.

Your refund will be issued once the mattress is received by us or by one of our charitable associations.

For hygiene purposes, the COZYbed pillow cannot be returned for a refund.

100 night returns policy

If you are not satisfied with our mattress, you may return it within 100 nights of purchase.

To be issued with a refund, you will need to let us know and we will arrange for the mattress to be picked up. You may also cancel your order prior to shipment.

To initiate a successful returns process, you must have been a full paying customer and slept on your mattress for at least 30 nights. The 30 nights will allow your body to successfully adjust and experience the full comfort of the mattress.

We will require a receipt or proof of purchase. If you did not purchase your mattress, you are not eligible for a return.

Please note that the trial is limited to one return or exchange per household, and it must be exercised directly through COZYbed no later than 100 nights after delivery of your product.

In the event of an exchange, you will be responsible for any difference in pricing of your new product.

If you are a rural customer living outside of metro locations of Brisbane, Sydney, Melbourne, Adelaide, Perth and Hobart you are also eligible for a full refund, however, you will be responsible for any freight and charges associated with the returns process to get the mattress to us or to our closest charitable association.

If you live in any of the aforementioned metro locations, you agree that you will make yourself available for the scheduled pick up time. In the event that a courier is not able to collect the returned mattress at the scheduled pick up time, the cost of any subsequent pick up/s will be recharged to you at full price. We reserve our rights to refuse the return of a mattress with any non-compliance in scheduling returns.

You will not be granted with a refund if the mattress is not in a donatable condition. That is, no damage, stains, tears, or other soiling including odors.

For hygiene purposes, the COZYbed pillow cannot be returned.

Gifts

In the event that you wish to return a mattress which was originally purchased and marked as a gift, you’ll receive a gift credit for the value of the returned mattress.

Once the mattress is received by us or one of our charitable associations, you will be sent a gift credit to use in your future purchase from us.

Delivery

In the event that you are unable to accept delivery, you must promptly notify us before a delivery is attempted.

It is your responsibility, and you agree, to provide us with current, complete and accurate delivery information for all your purchases. You agree that you will promptly update us with any new delivery information. You agree that you will accept full delivery charges in the event of a failed delivery. The courier will only take the mattress to your front door and for safety and insurance purposes are not permitted to enter households.

We will endeavour to make all reasonable attempts to notify you of the delivery to ensure that you are able to receive the delivery successfully.

If you are unable to accept delivery, you may give us a written authority, prior to delivery, agreeing to allow the courier to leave the mattress near your front door. If you choose this method of delivery, you are automatically taken to have agreed to accept sole responsibility for any liability, damage, lost or stolen product.

Limitation on liability

The use of the information on this Website is at your own risk. COZYbed its directors, employees, shareholders, agents and other representatives will not, under any circumstances, be liable for any injury, loss or damage arising out of or related to the use, or inability to use, information on this Website or provided through this Website by email.
This limitation of liability includes, but is not limited to compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and third party claims.
To the maximum extent permitted by law, COZYbed disclaims all liability for any errors or omissions contained in this information or any failure to update or correct this information. It is your responsibility to assess and verify the accuracy, completeness and reliability of the information on this Website.

To the maximum extent permitted by law, COZYbed is not liable to you or anyone else for any:

  • decision, action or inaction taken in reliance on the information in, or connected with, any of the service and all products and services delivered to you through the service;
  • losses, costs or damages suffered or incurred by you, including (without limitation) direct or indirect, special, incidental, compensatory, exemplary or consequential damages, or any similar damages, whether based in contract, tort (including negligence) strict liability or otherwise, arising from or in connection with the service and all products and services delivered to you through the service;
  • your use or misuse of the website or any information or material contained in the website;
  • the loss or modification of information or material transmitted from the website;

  • the product being unavailable at any time or not being delivered within a specified time period;

To the maximum extent permitted by law, COZYbed does not make any guarantees or warrants that the Website will be available in any place, free of faults or error, free from unauthorised interception or access, or free from blockages, delays, network failure, congestion, interferences of faults of any kind.

Some states do not allow the exclusion or limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by those laws.
